Environmental Health - Liquor Licence Objections
An applicant for a
new liquor licence, the renewal of a licence or the variation of the
conditions of an existing licence, must place two Public Notices in the
Papakura Courier (unless the Licensing Agency otherwise allows). The
second one should appear in the Papakura Courier the week following the
first publication.
All objections to an
application must be received within 10 working days following the first
publication of the Public Notice.

Objection criteria for On licences
An objection to an On
licence application must be based on the criteria contained within
section 13(1) of the Sale of Liquor Act 1989, which are:
(a) The
suitability of the applicant:
(b) The days on
which and the hours during which the applicant proposes to sell liquor:
(c) The areas of
the premises or conveyance, if any, that the applicant proposes should
be designated as restricted areas or supervised areas:
(d) The steps
proposed to be taken by the applicant to ensure that the requirements of
this Act in relation to the sale of liquor to prohibited persons are
observed:
(e) The
applicant’s proposals relating to —
(i) The sale or
supply of non-alcoholic refreshments and food; and
(ii) The sale and
supply of low- alcohol beverages; and
(iii) The provision
of assistance with or information about alternative forms of transport
from the licensed premises:
(e) Whether the
applicant is engaged, or proposes to engage, in—
(i) The sale or
supply of any other goods besides liquor; or
(ii) The provision of
any services other than those directly related to the sale or supply of
liquor,— and, if so, the nature of those goods or services

Summary of
Objection criteria for Off licences
An objection to an
Off licence application must be based on the criteria contained within
section 35(1) of the Sale of Liquor Act 1989, which are:
(a) The
suitability of the applicant:
(b) The days on
which and the hours during which the applicant proposes to sell liquor:
(c) The areas of
the premises, if any, that the applicant proposes should be designated
as restricted areas or supervised areas:
(d) The steps
proposed to be taken by the applicant to ensure that the requirements of
this Act in relation to the sale of liquor to prohibited persons are
observed:
(e) Whether the
applicant is engaged, or proposes to engage, in—
(i) The sale or
supply of any other goods besides liquor; or
(ii) The provision of
any services other than those directly related to the sale or supply of
liquor,— and, if so, the nature of those goods or services

Objection criteria for Club licences
An objection to a
Club licence application must be based on the criteria contained within
section 59(1) of the Sale of Liquor Act 1989, which are:
(a) The
suitability of the applicant:
(b) The days on
which and the hours during which the applicant proposes to sell liquor:
(c) The days on
which and the hours during which the premises are used for the club’s
activities:
(d) The areas of
the premises or conveyance, if any, that the applicant proposes should
be designated as restricted areas or supervised areas:
(e) The
proportion of the membership of the club who are prohibited persons:
(f) The steps
proposed to be taken by the applicant to ensure that the requirements of
this Act in relation to the sale of liquor to prohibited persons are
observed:
(g) The
applicant’s proposals relating to —
(i) The sale or
supply of non-alcoholic refreshments and food; and
(ii) The sale and
supply of low- alcohol beverages; and
(iii) The provision
of assistance with or information about alternative forms of transport
from the licensed premises

An objection to the
renewal of on, off or club licence must be based on the relevant
sections of the Sale of Liquor Act 1989 containing the criteria, which
are:
(a) The
suitability of the applicant:

conditions attaching to the licence:

The manner in which the licensee has conducted the sale and supply of
liquor pursuant to the licence

Summary of Objection criteria for variation of On, Off or Club licences
An objection to the
variation of an existing on, off or club licence must be based on the
appropriate on, off or club criteria relevant to the application. The
objection criteria for a renewal and variation (e.g. extended hours)
could be:
(a) The
suitability of the applicant:
(b) The
conditions attaching to the licence:
(c) The manner in
which the licensee has conducted the sale and supply of liquor pursuant
to the licence:
